Gary Samms Talks about the Lawsuit Alleging “Skill” Games Are Illegal Gambling in the Legal Intelligencer

Gary Samms, who chairs Obermayer’s Professional Liability Practice Group and the Catastrophic Loss Group, continues his discussion about the legality of POM’s machines in an interview for The Legal Intelligencer, published on May 9, 2023. On May 5, U.S. District Judge Michael Baylson of the Eastern District of Pennsylvania denied a motion to dismiss by Georgia-based Pace-O-Matic.

Since Gary’s 2022 interview for The Wall Street Journal, when the lawsuit was still pending, a federal judge had allowed the casino’s lawsuit challenging the devices in federal court to proceed.

“ The racketeering or RICO case is a significant one and the defendants did not challenge the elements of the RICO claim itself,” Gary Samms said. “The ongoing violation of Section 5513 of the Crimes Code, and these illegal slots must be stopped and the injured parties, like Parx, appropriately compensated. The damages are significant and getting larger by the day.”
