Gary Samms Secures a Defense Verdict on Behalf of a Family Practitioner

On October 18, 2022, Gary Samms, who chairs Obermayer’s Professional Liability Practice Group and the Catastrophic Loss Group, secured a defense verdict for a family practitioner in Chester County before the Honorable William P. Mahon after seven days of trial. Plaintiff had alleged the doctor failed to perform diagnostic exams which would have led to the discovery of an unclassified renal cell carcinoma, which ultimately led to the death of the patient. 

The matter was a very emotionally charged case, as the 30-year-old single mother of two left very young children after her demise. The jury returned a unanimous verdict on behalf of Gary Samms’ client. Integral to the defense were Raymond Petruccelli and Barbara Heaton.
