Gary Samms Obtains a Unanimous Defense Verdict on Behalf of a Surgeon and Einstein Hospital

After a five-day jury trial in the Philadelphia Court of Common Pleas, Obermayer partner Gary Samms obtained a unanimous defense verdict on behalf of a surgeon and Einstein Hospital. The plaintiffs alleged the doctor committed malpractice by failing to appropriately diagnose and treat a colon perforation after a pancreaticoduodenectomy. The Honorable Anne Butchart presided over the trial, centered around complicated medicine regarding the removal of ampullary cancer in the head of the pancreas. The Plaintiff contracted sepsis and permanent atrial fibrillation resulting in four months of institutionalized care, a permanent pacemaker, and numerous surgeries.
