January 28, 2022

The chair of Obermayer’s Transparency and Public Data Practice, Terry Mutchler, was quoted in Spotlight PA in connection with the PA’s biggest pension fund investment calculation scandal that had led to multiple federal investigations. The board of the Public School Employees’ Retirement System (PSERS) has repeatedly delayed the release of the report on issues under federal investigation. On Thursday, January 20, 2022, the chairman of the Pennsylvania Public School Employees’ Retirement System board told members in an email that they must sign a yet-to-be-drafted non-disclosure agreement to participate in a closed-door meeting later this month.

Katie Muth (D., Montgomery), said she would ask the agency’s lawyers to provide a legal basis for their NDA request, which Terry called problematic and antithetical to government transparency. She also added:

“This is a moment for PSERS to let some sunlight in, as opposed to doubling down on secrecy.”
