Tips and Techniques for Achieving Desired Outcomes for REAs and Claims in 2021

Join Aaron Raddock of BDO and Maria Panichelli of Obermayer on Wednesday, April 7 as they explore the path to successful REAs and Claims in 2021. Our industry leader-hosts will provide attendees with an overview of issues relating to these two critical ways in which contractors can seek compensation for issues arising during federal projects. Both Requests for Equitable Adjustment and Claims allow a contractor to seek an extension of the contract period performance, and/or an increase in contract price when unanticipated issues cause the contractor to experience delays or incur unanticipated costs. REAs and Claims can only be successful, however, when a contractor has a thorough understanding of the REA and Claims processes and understands how to properly protect their interests and preserve their rights. This presentation will give contractors the tools they need to file successful REAs and Claims in 2021. In this webinar, each of our hosts will discuss topics relevant to their focus industry areas:

Maria, an experienced government contracts attorney, will provide attendees with an overview of the legal issues relating to REAs and Claims. She will provide a basic summary of what REAs and Claims are, what they allow you to do, and the legal bases supporting them. Attendees will learn about the differences between these strategies, and when to use each. Maria will describe the most common bases for REAs and Claims, and will discuss the most common COVID-related types of claims. Finally, Maria will walk attendees through the claims appeal litigation process, including subcontractor pass-through claims and common government defenses.

Aaron, an experienced government-contracting accountant and consultant, will discuss some financial concerns relating to REAs and Claims. He will describe the contents of a successful REA/claim package, explore various methodologies for preparing the quantum, and provide practical tips and techniques for withstanding audit scrutiny and avoiding pitfalls. He will also discuss some of the nuances of preparing an REA or claim related to the impacts of COVID-19.
