David is an attorney in Obermayer’s Litigation Department. He focuses his practice on medical malpractice and professional liability defense. David represents health care providers including hospitals, health systems, physicians, nurses, long-term care providers, dentists, and health care support staff in professional liability matters, licensing disputes, staff privilege issues, state investigations, and related insurance concerns.
David enjoys helping people. He specifically joined Obermayer’s litigation department because he wanted to help doctors and other health care providers successfully navigate the legal system.
David has over twenty years of experience handling complex litigation. Before joining Obermayer, he worked at a New York-based class action law firm for approximately two years where he primarily handled antitrust class action litigation and qui tam litigation.
Some of the notable cases that David worked on include:
- In re Generic Pharmaceuticals Pricing Antitrust Litigation, 16-md-2724 (E.D. Pa.) – multidistrict litigation alleging that pharmaceutical companies artificially inflated the price of certain generic drugs in violation of federal antitrust laws;
- In re Zetia (Ezetimibe) Antitrust litigation, MDL No. 18-md-2836 (E.D.Va.) – multidistrict litigation alleging that defendants entered into an unlawful agreement to delay generic competition;
- U.S. ex rel. Streck v. Bristol-Myers Squibb Co., No. 2:13-cv-7547-TJS (E.D.Pa.) ($75 M settlement).
Prior to that position, David worked at a Philadelphia-based class action law firm for over eighteen (18) years where his practice primarily focused on securities fraud and antitrust litigation. While at that firm, he also served for over a decade as the Partner in charge of the day-to-day operations of the firm’s Global Portfolio Monitoring Platform. In that capacity, David managed a team of attorneys and paralegals that provided global portfolio monitoring services to a significant client base of institutional investors that included public pension funds, Taft-Hartley funds, and asset managers.
Early in his career, David handled medical malpractice and product liability litigation. He also served as a Law Clerk to the Honorable Bernard J. Goodheart in the Philadelphia Court of Common Pleas.
David served a three-year term as a member of the Executive Committee of the Philadelphia Bar Association’s Young Lawyers Division where he Co-Chaired Legal Line, P.M. for three consecutive years. Under his leadership, Legal Line, P.M. won the National Association of Bar Executives LEXIS Community and Education Outreach Award. David also formerly served as a member of the Philadelphia Bar Association’s State Civil Committee and the Pennsylvania Trial Lawyers Association’s New Lawyer Section Leadership Council.
David currently serves and has served for more than 10 years, as a member of the Penn Alumni Interview Program where he is responsible for interviewing prospective freshmen. David previously served as a member of the Board Directors of the Penn Alumni Club of Philadelphia where he served a two-year term as President as well as Chair of the Membership Committee. He also served as a member of the Board of Directors of Penn’s Alumni Class Leadership Council where he served a two-year term as Chair of the By-Laws Committee.
Additionally, David currently serves as a Class Agent for his graduating class from The William Penn Charter School. He has served in that role for nearly twenty-five years. He also previously served as a member of the Board of Directors of the Alumni Society of The William Penn Charter School where he served a one-year term as Secretary.
