Gary Samms and Eileen Keefe successfully obtained a defense verdict for a pediatric surgeon in a medical malpractice case in Philadelphia. The surgeon was accused of performing three abdominal surgeries, (one on day 2 of life), incorrectly which allegedly lead to cardiac arrest and hypoxia resulting in Cerebral Palsy, brain injury and the need for a feeding tube. Samms and Keefe explained in the proceedings there was no mechanical obstruction causing the child’s gastric issues, but that the duodenum had malrotated before birth and the real cause of the child’s issues was hypomotility. Plaintiff’s life care plan for the child was between $83 million and $123 million, depending on life expectancy.
