Terri Gillespie and Jim Penny won a victory in the U.S. Third Circuit Court of Appeals affirming the lower court’s entry of summary judgment (also a victory for Terri and Jim) for the defendant employer in an ADA case in which the employee claimed unlawful retaliation because, after she sought a disability accommodation, the employer terminated her employment.

Mr. Penny is a partner with Obermayer Rebmann Maxwell & Hippel LLP. He is former Chairman of the firm’s Labor Relations and Employment Law Department.
