D.C. Court of Appeals Invalidates NLRB’s Notice Posting Rule

In a unanimous decision, the D.C. Court of Appeals rejected the National Labor Relations Board’s “notice posting rule” which would have required employers to conspicuously display the Board’s employee-rights poster informing employees of their rights under the National Labor Relations Act (“NLRA”), including the right to form, join or assist a union.  National Association of Manufacturers v. NLRB, No. 12-5068.  As a result, employers are not required to post the NLRB’s poster.

Obermayer's Samms and Roe Obtain Defense Verdict for Radiologist in Medical Malpractice Case Over Identifying Aneurysm

Obermayer's Gary M. Samms and Jacqueline Sabol Roe received a defense verdict in a medical malpractice action in the case of Piasecki v. University of Pennsylvania, et al. Mr. Samms and Ms. Roe defended a radiologist, where plaintiff’s allegation was that he failed to identify an aneurysm on an MRI/MRA study. The aneurysm eventually ruptured and left the plaintiff neurologically debilitated. The original demand in the case had been $2 million.
