James E. Kurack, Jr. is a senior associate with Obermayer Rebmann Maxwell & Hippel LLP. He has a diverse practice focused on business and technology based litigation, e-commerce, Internet law, information technology, lender liability, loan workouts, defamation, data security and privacy.
Mr. Kurack counsels and represents clients in all industry sectors on a variety of technology issues such as data security breaches, technology use policies, software agreements, electronic records management, social media, domain name disputes and workplace privacy. He works with clients to develop privacy policies as well as data retention and destruction polices and procedures for safeguarding information. Mr. Kurack also advises clients on a wide array of state and federal privacy laws, such as the HITECH Act, the Health Insurance Portability and Accountability Act ("HIPAA"); the Electronic Communications Privacy Act ("ECPA") and Pennsylvania's Breach of Personal Notification Act among others.
Mr. Kurack was recently appointed as an Adjunct Professor at Drexel University’s Richard C. Goodwin College of Professional Studies where he teaches a course on Informational Technology Security Policies. The course covers legal issues associated with data security breaches, social networking, document retention and destruction as well as privacy issues in the workplace.
Mr. Kurack strives to keep current on the ever changing landscape of privacy and data security issues affecting Pennsylvania businesses. Mr. Kurack has authored articles in the areas of data security and privacy. His publications include:

Mr. Kurack is also an experienced litigator. He has represented clients on a wide range of matters with a particular emphasis on contract disputes, fraud, professional liability, employment issues and matters involving “business divorces.” Mr. Kurack has also handled matters involving leases and real estate, non-competition agreements and restrictive covenants, theft of proprietary information, franchise agreements, zoning, business torts and insurance coverage.
In 2007, Mr. Kurack was named as one of the “Pennsylvania Rising Stars” as noted in Philadelphia magazine and “Pennsylvania Super Lawyers® - Rising Stars Edition.” Rising Stars are chosen by their peers as being among the top up-and-coming lawyers in the Commonwealth. Only 2.5 percent of Pennsylvania attorneys receive this honor each year. As a Rising Star, Mr. Kurack was featured in a special section of the December 2007 issue of Philadelphia magazine and Pennsylvania Super Lawyers – Rising Stars Edition.
Following law school, Mr. Kurack was a law clerk to the Honorable Ariel A. Rodriguez, Superior Court, Appellate Division of New Jersey. Mr. Kurack earned his Juris Doctor degree from Villanova University School of Law, cum laude. While at Villanova, he served as Special Projects and Business Editor of the Villanova Sports & Entertainment Law Journal. He received his Bachelor of Science degree in political science, summa cum laude, from Campbell University, Buies Creek, North Carolina. Mr. Kurack is a member of the Philadelphia, Pennsylvania, and American Bar Associations. Mr. Kurack is admitted to practice in Pennsylvania, New Jersey, the United States District Court for the Eastern District of Pennsylvania, the United States District Court for the District of New Jersey and the United States Court of Appeals for the Third Circuit.
